DMV Hearings
After a person has been arrested for DUI charges, they have the option of scheduling a DMV Hearing. A DMV Hearing is an administrative proceeding regarding a person’s driving privileges. Generally, DMV hearings determine whether the driver’s license will be suspended or revoked.
If you choose to schedule a DMV hearing, you must contact the DMV Office of Driver Safety within 10 days after the arrest. Failure to do so will waive your right to a hearing and automatically suspend your driver’s license for four months. Once a DMV hearing is scheduled, the DMV will stay the suspension or revocation until the outcome of the hearing is determined.
A DMV hearing is NOT the same a civil or criminal court hearing. The DMV hearing does not determine if a person is innocent or guilty of a DUI. The DMV hearing only determines driving privileges and the circumstances surrounding the arrest. The driver and his/her attorney have the opportunity to present evidence, witnesses, and testimony in favor of his/or her behalf.
