How does bail work?
All individuals charged with a criminal offense have the right to post bail. Bail is the cash equivalent to the charges brought against the defendant, and is set by the judge. When the defendant “posts” bail, it ensures that he/she will appear in court when at the appropriate scheduled time. When the defendant appears in court, the court will refund the bail. When the defendant fails to appear in court, bail is retained and the court issues a warrant for the defendant’s arrest.

A misdemeanor is criminal offense that usually results in fines or less than a year in jail. Misdemeanor offenses are not as severe as a felony offense, and generally result in lighter penalties.
